These Terms of Service ("Terms") govern your access to and use of TokenIntel's website (tokenintel.band), datasets, API services, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use our Services.

Definitions

• "You" or "User" refers to the individual or entity accessing our Services
• "We", "Us", or "TokenIntel" refers to the service provider
• "Dataset" refers to the blockchain intelligence data provided through our Services
• "API" refers to the application programming interface for accessing our data
• "Free Sample" refers to the limited dataset available for evaluation purposes
• "Full Access" refers to paid subscription tiers with complete dataset and API access

License Grant and Restrictions

Free Sample License

The Free Sample dataset is provided for evaluation purposes only. You may:

• Download and analyze the data for personal, non-commercial evaluation
• Test integration with your systems
• Assess data quality and suitability for your use case

You may NOT:

• Use the Free Sample for commercial purposes or production systems
• Redistribute, resell, or sublicense the data to third parties
• Reverse engineer or attempt to recreate our data collection methods
• Remove or modify any proprietary notices or labels

Full Access License

Full Access subscribers receive a limited, non-exclusive, non-transferable license to:

• Access and download complete datasets
• Use the data for commercial purposes, including building trading bots and risk assessment tools
• Integrate data via API into your applications
• Create derivative works and analyses based on the data

Full Access subscribers may NOT:

• Redistribute raw datasets to third parties without written permission
• Resell or sublicense API access to others
• Use the data for illegal activities or market manipulation
• Exceed API rate limits or attempt to circumvent access controls

User Obligations

By using our Services, you agree to:

• Provide accurate and complete information when registering or requesting access
• Maintain the confidentiality of your API credentials
• Notify us immediately of any unauthorized use of your account
• Comply with all applicable laws and regulations
• Not use the Services to harm, threaten, or harass others
• Not attempt to gain unauthorized access to our systems or data
• Not interfere with or disrupt the Services or servers

Payment and Subscription

Full Access to our Services requires a paid subscription. Payment terms include:

• Subscription fees are billed in advance on a monthly or annual basis
• Prices are subject to change with 30 days' notice
• All fees are non-refundable except as required by law
• You are responsible for all taxes associated with your subscription
• Failure to pay may result in suspension or termination of access

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

While we strive to provide accurate and up-to-date data, we make no warranties or representations regarding:

• The accuracy, completeness, or reliability of the data
• The suitability of the data for any particular purpose
• The availability or uptime of our Services
• The performance or results obtained from using the data

Blockchain data is inherently complex and may contain errors or inconsistencies. You are solely responsible for verifying data accuracy and making your own investment decisions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOKENINTEL SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Trading losses or investment decisions based on our data
• Interruption or errors in the Services
• Unauthorized access to or alteration of your data

Our total liability for all claims arising from your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless TokenIntel and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations

Intellectual Property Rights

All content, features, and functionality of our Services (including datasets, software, algorithms, text, graphics, and logos) are owned by TokenIntel and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our express written permission.

Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Abuse of API rate limits or system resources
• Any other reason at our sole discretion

Upon termination, your license to use the Services will immediately cease, and you must delete all copies of our data.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the new Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TokenIntel operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration, except where prohibited by law.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TokenIntel regarding the Services and supersede all prior agreements and understandings.
